ARLAWhat is the Landlords Checking Scheme? How will new Immigration Act measures be enforced and what are the penalties?

ARLA are hosting the second of two free seminars in the pilot areas for the Landlord Checking Scheme, a scheme which forms part of the Immigration Act measures to tackle illegal immigration.  The upcoming seminar in West Bromwich will be hosted by ARLA MD David Cox, and will look at the issues thrown up by the legislation, concerns raised by members, the civil penalty scheme and pilot evaluation.

The pilot, which comes into force on 1st December, will affect new tenancies within the local authority areas of Birmingham, Wolverhampton, Sandwell, Walsall and Dudley. From this date landlords and letting agents who are found to have let property to occupiers without carrying out the specified right to rent checks, will be liable for a civil penalty ranging from £80-£3,000 per illegal occupant.

The scheme forms part of the government’s strategy to limit the ability of illegal migrants to remain in property and move around undetected, and tackle overcrowded and unlawful rental properties, commonly termed ‘beds in sheds’.
